The Bill (Reg. No. 1178) coordinates the regulations of the current Law that establish compulsory notarial attestation of real estate lease contract, provided a leaser is a natural person, non-subject of entrepreneurship, with the regulations of the civil legislation of Ukraine. The Bill introduces amendments stating that the natural persons are to register notarially the real estate lease contracts only in cases defined by the Laws of Ukraine.
The Committee members stated that "in case the said amendments are introduced, notarial attestation of real estate lease contract will become non-obligatory, which considerably extends probability of personal income tax avoidance and complicates its administration".
The People´s Deputies emphasized that the Law "On Personal Income Tax" is a constituent of the tax legislation. Therefore, its coordination with the civil legislation is not deemed necessary. Moreover, the Bill lacks financial and economic argumentation, though the People´s Deputies believe that "its introduction can result in reduced budget revenue".
